We all as Indian ashamed of such heinous act that shown by Unnao, Kathua, Surat rape case. As per the record of NCRB, there is 30-40% of the times children (0-17 year) are victims of rapes.In 2016, 43.3% of the total female rape victims were minors. It shows us that even if there is stringent law criminal is ready to make “an eye for an eye” against crime “and making itself blind”.
In India, there are some fundamental laws which relate to child sexual abuse (child sexual abuse in a domestic sphere).It Deals with sexual abuse by relative or any person who are in contact with the child but problem under this law is that a child would not make any complaint against their relatives or trustworthy person or also sometimes the member is within the family so many times parent neglect the case. So there should be provision needed in law that, under any circumstances, child sexual abuse should be Registered as FIR by their parents within 24hrs.
Another one is “child abuse in juvenile justice homes act”. Even if such act exist most of the times caretaker or security guards of this green homes abuses the child. As per the child sexual abuse bill 2011 which only deals with victims biological age but not with victims mental age creates anxiety over child sexual abuse cases.
In 2012 parliament passed POSCO(Protection of Children against Sexual Offences Act) which deals with a gender-neutral child under age 18. It makes victims parent/trustworthy to compulsory make complaint against child abuse.It provides punishment to a criminal with seven years to max life imprisonment. If a criminal is any authority based person or police officer(as in this kathua case), it provides punishment from 10 years to life imprisonment. The debate arises over this kathua rape case that trial under this act should increase to a death sentence. Along with these all, Lawmakers must give attention towards child pornography cases. It all of our shows that Problem is not with the law it is with our thinking to look.
